Terms of Service

Please read these Terms of Service carefully before using our Website or Apps or booking services through them. By accessing or using our Website or Apps, you confirm that you accept these Terms and all policies incorporated into them, and you agree to comply with them. If you do not agree, you must not use our Website or Apps.

1. About us

The website located at www.barberspot.co (the “Website”) and the BarberSpot mobile applications (together, the “Platform”) are operated by ValuraTech Ltd, a company registered in the Federal Republic of Nigeria (Company No. 8835005) (“ValuraTech”, “BarberSpot”, “we”, “us” or “our”).

In these Terms, “you” or “your” means the person who accesses or uses the Platform.

2. What we provide

2.1 browse and book grooming and related services offered by independent third-party service providers (each a “Barber” or “Partner”); and

2.2 access general informational content made available on the Platform.

Any informational content is provided for general purposes only and is not professional advice (including medical advice). You should obtain professional advice relevant to your circumstances before acting on any information on the Platform.

3. Other policies that apply

These Terms incorporate the following policies (together, the “Terms and Policies”):

  • 3.1 Privacy & Cookies Policy (how we process personal data);
  • 3.2 Booking Terms and Conditions (terms that apply when you book services); and
  • 3.3 User Generated Content Policy (rules for content you upload or post).

If there is a conflict between documents, the following order applies: Booking Terms (for bookings) → these Terms → other policies.

4. Eligibility and accounts

4.1 You must be at least 18 years old to create an account and make bookings on the Platform.

4.2 You are responsible for ensuring that information you provide is accurate and up to date.

4.3 We may refuse registration, suspend, or terminate accounts where permitted by law, including where we reasonably suspect misuse, fraud, or breach of these Terms.

5. Account security

5.1 You are responsible for keeping your login details confidential and secure.

5.2 You must notify us promptly if you suspect unauthorized use of your account.

5.3 We may require you to reset credentials or take additional steps to secure your account.

6. Acceptable use and misuse

You must not misuse the Platform. In particular, you must not:

  • 6.1 introduce malware (including viruses, trojans, worms, spyware) or attempt to disrupt the Platform;
  • 6.2 attempt to gain unauthorized access to the Platform, its servers, or related databases;
  • 6.3 perform denial-of-service or similar attacks; or
  • 6.4 use the Platform in a way that is unlawful, fraudulent, or harmful.

We may suspend or restrict access where we reasonably believe misuse has occurred and may report unlawful activity to relevant authorities where required.

7. Booking services: our role and your contracts

7.1 Barbers are independent third-party providers. Unless stated otherwise, services are provided by the Barber, not by BarberSpot.

7.2 When you book a service through the Platform, you may form: (a) a contract with BarberSpot for Platform-related booking and payment facilitation (the “Platform Contract”); and (b) a contract with the Barber for the delivery of the booked service (the “Barber Contract”).

7.3 The Barber is responsible for delivering the booked service, including service quality, professional standards, and compliance with applicable laws and regulations.

8. Prices, payments, and payment processing

8.1 Prices and available payment methods are shown at checkout. Unless “Pay at Venue” (or a similar option) is available and selected, payment is taken at the time of booking in Nigerian Naira (NGN).

8.2 Payments may be processed by third-party payment providers (for example, Paystack and/or Stripe). Their terms may also apply to the payment transaction.

8.3 Where BarberSpot collects payment on behalf of a Barber, BarberSpot does so as the Barber’s commercial agent. Once we have successfully received payment for a booking, your payment obligation to the relevant Barber for that booking is discharged to the extent of that payment.

9. Cancellations, no-shows, and refunds

9.1 Cancellation rules (including any cancellation fee) will be disclosed to you before you confirm your booking.

9.2 You may cancel a booking in accordance with the cancellation rules shown at checkout and in your booking confirmation.

9.3 If a cancellation fee applies (as set by the Barber and when it is less then 120 minutes to the booked time), it may be charged where you cancel within the restricted period or do not attend (a “no-show”), as disclosed at checkout.

9.4 Approved refunds are processed back to the original payment method, subject to processing times of banks and payment providers.

10. User-generated content

10.1 “User Generated Content” (“UGC”) means content you submit through the Platform, including text, images, reviews, profile information, and other materials.

10.2 You confirm that you have the rights to submit your UGC and that it does not violate laws or third-party rights.

10.3 We may moderate, edit, remove, or refuse to publish UGC at our discretion, subject to applicable law.

10.4 UGC must not be illegal, defamatory, misleading, abusive, harassing, hateful, sexually explicit, or otherwise inappropriate, and must not include spam or unauthorized advertising.

11. Intellectual property

11.1 We own (or license) the Platform and its content, including trademarks, logos, designs, and software, except where stated otherwise.

11.2 You may access and use the Platform for personal, non-commercial purposes in accordance with these Terms. You must not copy, modify, distribute, sell, or exploit any part of the Platform except as permitted by law or with our written permission.

12. Availability and changes to the Platform

12.1 We may update, modify, suspend, or withdraw any part of the Platform at any time. We do not guarantee that the Platform will always be available or error-free.

12.2 We may make changes to these Terms from time to time. The latest version will be available on the Platform. Where required by law, we will notify you of material changes.

13. Liability

13.1 Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law.

13.2 Subject to 13.1, BarberSpot is not liable for indirect or consequential losses (such as loss of profit, loss of business, loss of opportunity) arising out of or in connection with your use of the Platform.

13.3 To the extent permitted by law, BarberSpot is not responsible for the acts, omissions, or service quality of Barbers, who are independent third-party providers. Your rights in relation to the service itself are primarily against the relevant Barber under the Barber Contract.

14. Service territory

The Platform is intended for users in the Federal Republic of Nigeria. If you access the Platform from outside Nigeria, you do so at your own risk and are responsible for compliance with local laws.

15. Governing law and jurisdiction

These Terms and any dispute arising out of or relating to them are governed by the laws of the Federal Republic of Nigeria. The courts of Nigeria will have non-exclusive jurisdiction.
